The Commercial Agents (Council Directive) Regulations 1993 provide protection for both the Commercial Agent whose agency may be terminated by the Principal and for the Principal where the Agent, for example, acts in bad faith or is at fault.
The problem often lies in the interpretation. What constitutes 'bad faith'? What happens when an Agent is forced to resign because of a breach committed by the Principal? What happens when parts of the agreement are verbal?
