McCabe Pilgrimages. Terms and conditions

 

1. Deposit, confirmation of your booking and balance due

On receipt of your completed and signed booking form and deposit of £100 per person, we will send you your confirmation booking invoice. The deposit is non-refundable, except in the circumstances set out in paragraphs 4 and 5 and forms part of your holiday payment.  It is then that a firm contract exists between you and McCabe Travel Limited, on the basis of these information notes. The confirmation will show the cost of your holiday and gives the date by which the balance must be paid. The date will be eight weeks prior to departure. Should there be any increase in the cost of your holiday, a revised invoice will be sent shortly before the balance due date. The amount indicated therein should be paid. If payment is not received by the balance due date,  we reserve the right to cancel all arrangements. For bookings made within eight weekr bookings made within eight weeks of departure, full payment at the time of booking must be made. Insurance premiums will automatically be included on your invoice unless 'NO' is written in the box on the booking form.

2. If you change your booking

Occasionally you may find it necessary to alter the booking having received our confirmation invoice. We will do our utmost to make the changes without charge, but this may occasionally be necessary when dealing with airlines or hoteliers etc.

3. If you cancel your booking

Should you or a member of your party be forced to cancel, it is necessary that you advise us or your travel agent in writing. The letter should be signed by the person who signed the original booking form. We cannot action a cancellation until we have received the letter of cancellation. Cancellations are subject to a charge payable by you to cover our estimated losses. The following is our scale of charges:

If the reason for a cancellation falls within the terms of your Holiday Insurance Policy, you should make a claim to the insurance Company for recovery of the charges. We would like to remind passengers that insurance premiums are not refundable.

4. If we alter your booking

If we are forced to make any material alterations to your tour, i.e. flight timings may alter or a hotel may close down, we shall inform you without delay. We do reserve the right to make these changes and, should the change be such that in our judgement it alters the nature of your tour, we shall give you the choice of either accepting the alteration which will be of at least comparable standard, if available, or of receiving a full refund of all money paid. If this should occur within eight weeks prior to departure, £15 compensation will be paid and, if it should occur within 14 days of departure, the amount of compensation will increase to £30. Important note: Compensation will not be payable if we are forced to cancel or in any way change your holiday due to war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire or adverse weather conditions or other similar circumstances beyond the company's control.

5. If we cancel your holiday

In the unlikely event of us having to cancel your holiday we will inform you not later than eight weeks prior to departure. Unfortunately, for reasons of 'Force Majeure', for example war, civil disturbances, acts of God, act of government or strikes, a tour may have to be cancelled. If such does occur we will help you book an alternative tour or will promptly refund all the money you have paid us.

6. Price guarantee

All prices are based on the following exchange rate as quoted in the 'Financial Times Guide to World Currencies' on 27th August 2002:
£1 = 1.52 American Dollars. The price of your holiday is subject to surcharges on the following items: government action, currency, aircraft fuel, overflying charges, airport charges and increases in airfares. Even in this case, we will absorb an amount equivalent to 2% of the holiday price, which excludes insurance premiums. Only amounts in excess of 2% will be surcharged but if this means paying more than 10% on the holiday price you will be entitled to cancel your holiday with a full refund of all money paid except for any premium paid to use for holiday insurance. Should you decide to cancel because of this, you must exercise your right to do so within 14 days from the issue date printed on the invoice. In exchange for the risk to us in giving this assurance and protection against inflation, no refunds, in the event of favourable cost variation, will be made.

7. Our responsibility

We do our best to make sure that your holiday arrangements are acceptable. McCabe Travel and/or our agents will check that the standards of hotels and coach companies are acceptable. We accept responsibility for ensuring the holiday you book with us is supplied as described and the services offered reach a reasonable standard. If any part in not provided as promised, we will pay appropriate compensation if this has affected the enjoyment of your holiday. We accept responsibility for the acts and/or the omissions of our employees, agents and suppliers except where they lead to death, injury or illness. Our liability in all cases shall be limited to a maximum of twice the value of the holiday. We accept responsibility for injury, illness or death caused by the proven negligent acts of our employees, agents and subcontractors whilst acting within the course of their employment. With regard to carriage by air, sea or rail and the provision of accommodation, the liability in all cases will be limited by the relevant international convention. We shall offer every assistance to our passengers who through misadventure suffer illness, personal injury or death during the period of their holiday arising out of activity which does not form part of the tour arrangements up to a maximum of £5000 per booking form and subject to our reasonable discretion.

8. Conditions of travel

Airlines and other modes of transport have their own conditions of carriage some of which may limit liability towards you and your luggage. Copies of these can be inspected by prior arrangement with the appropriate company's head office.

9. McCabe reserves the right

We have the best interests of McCabe Travel's passengers at heart and so reserve the right to refuse to accept any person as a member of any group. We shall refund all monies that may have been previously paid by such persons, but no compensation will be payable in these circumstances.

10. If you have a complaint

We know that in spite of everything, problems can arise. If you have a complaint you must notify your local representatives who will do whatsoever they can to help you there and then. Most problems can be sorted out immediately and it is essential that you give McCabe Travel the opportunity to help you by letting our representative know quickly if you have any complaint. If you feel that a complaint has not been dealt with satisfactorily, please write to McCabe Travel within 28 days of your return to the United Kingdom.

11. ABTA Arbitration

Disputes arising out of, or in connection with, this contract which cannot be amicably settled, may (if the customer so wishes) be referred to arbitration under a special scheme which, though devised by arrangements with the Association of British Travel Agents, is administered quite independently by the Chartered Institute of Arbitrators. The scheme (details of which will be supplied on request) provides for a simple and inexpensive method of arbitration on documents alone with restricted liability on the customer with respect to costs. The scheme does not apply to claims for an amount greater than £1,500 per person. There is also a limit of £7,500 per booking form. Neither does it apply to claims that are solely or mainly in respect of physical injury or illness or the consequences of such injury or illness. The rules of the scheme provide that the application for arbitration must be made within nine months of the date of return from the holiday but in special circumstances it may still be offered outside this period.

12. Airport delays

Should a delay occur at the airport, the airline will provide assistance, drinks and meals and appropriate, with the assistance of the McCabe Travel representative.

 

These conditions are valid for departures during the period 1 January 2003 to 31 December 2004.
